In our practice, we find that many physical impairments also have a mental component. For example, if an individual has a back problem and is in constant pain, that’s going to cause depression, which is a mental problem. Let’s take the physical aspect out of the equation in response to this particular question. We have guidelines for mental disorders such as affective disorders, including depression or bipolar disorders or schizophrenia or paranoia or personality disorder. We have criteria that the judge will follow and the Social Security Administration will follow. If you meet those criteria, you are disabled because the system recognizes that a mental disability can be as or more disabling than a physical disability.
