Social security as part of their duties with respect to any claim for disability is charged with obtaining those records. Most of the time, they get them. Sometimes they don’t get them. Sometimes they only get partial records, and the records just do not appear. When you retain an attorney, for example, in our firm, we send out medical authorization forms to each and every treating doctor, and we’ll make sure that they get filed with social security.
If a doctor is uncooperative, we have statutes in the state of Florida which will subject that doctor to sanctions, so we generally don’t have a problem getting the medical records. It’s part of the attorney’s job in developing the case for his client.
