Let’s briefly go through the process of initial application through the appeal. The initial application is made directly through social security either online or in person. If you lose, you have 60 days to take an appeal. The first level of appeal is called reconsideration. In reconsideration, essentially the same group, it may be a different desk, it may be a different person but the same class of person will take another look at your claim. It’s very difficult to win on reconsideration. Nationally, only 10% of reconsideration claims are reversed. Therefore, ultimately, you want to get in front of a judge, if you’re been turned down. In order to get to a judge you must first go through reconsideration.. If you lose on recon, then you can go in front of a judge.
