I am going to review very briefly the appellate process. One files their initial claim. If they’re turned down, the first level of appeal is reconsideration. You have to file for that within 60 days. If you don’t file within 60 days, you’ve lost the right to appeal. It generally will take the social security administration approximately 3-5 months to make a decision on reconsideration. If you lose on reconsideration you go to the third level which is a hearing level in front of a live judge. It takes, unfortunately in the state of Florida, approximately a year and a half to get in front of that judge. Once the judge hears the case, generally you will get a decision somewhere between 2 and 4 months later. If you win of course, your benefits are retroactive at very least to the date that you filed your claim. You’re not losing money, you’re just trying to figure out how to survive without any money coming in during the appeals process..
